On April 13, 2011, Governor Brewer signed HB 2634 (Laws 2011, Chapter 96), which requires the Department to revise rules to reduce costs and streamline the regulatory process for health care institutions, including those providing behavioral health services. The new law also requires the Department to "facilitate licensure of integrated health programs that provide both behavioral and physical health services." The statutes in A.R.S. Title 36, Chapter 4 provide the authority for the licensure of health care institutions. A.R.S. § 36-405 allows the Department to classify and subclassify health care institutions and to adopt rules "to establish minimum standards and requirements for the construction, modification and licensure of health care institutions necessary to assure the public health, safety and welfare." A.R.S. § 36-405 also states that the "standards and requirements shall relate to the construction, equipment, sanitation, staffing for medical, nursing and personal care services, and record keeping pertaining to the administration of medical, nursing and personal care services, in accordance with generally accepted practices of health care."
The current rules for the licensing of health care institutions (not including health care institutions licensed as behavioral health service agencies) are in Arizona Administrative Code (A.A.C.) Title 9, Chapter 10. As part of implementing Laws 2011, Chapter 96, the Department has reviewed all of the rules regulating the licensing of health care institutions in 9 A.A.C. 10 and will be revising the rules to comply with statutory changes and current practice. In the revised health care institution licensing rules, the Department will also be including rules for new classes of health care institutions providing behavioral health services, currently licensed under rules in 9 A.A.C. 20.
As the draft rules are completed, the Department will be posting a link to the individual rulemakings on this webpage (see below) and will be soliciting comments. The Department will also be accepting comments about the rulemaking process and general comments through an online survey.
